Governo reabre o Refis e cria benefício para empresa que já tem parcelamento

Com a publicação nesta sexta-feira (14) da lei nº 13.043 (conversão da medida provisória nº 651), o governo reabriu o Refis da Copa –programa que facilita o acerto de contas para contribuintes com débitos com a Receita e a Procuradoria-Geral da Fazenda Nacional vencidos até 31 de dezembro de 2013. Agora, os contribuintes terão apenas mais 15 dias para aderir ao parcelamento. Esse prazo vai até o dia 28 de novembro

A adesão ao parcelamento está condicionada ao pagamento de antecipação nos seguintes percentuais: 5% se o valor total da dívida a ser parcelada for de até R$ 1 milhão; 10% se o valor for maior que R$ 1 milhão e até R$ 10 milhões; 15% se o valor for maior que R$ 10 milhões e até R$ 20 milhões; e 20% se o valor for maior que R$ 20 milhões. O contribuinte que quitar a dívida à vista terá benefícios extras, uma vez que os acréscimos (multas e juros) terão sensíveis descontos. No caso das multas de mora e de ofício e dos encargos legais, o desconto é de 100%; para a multa isolada (que normalmente decorre de descumprimento de uma obrigação acessória), é de 40%; e para os juros, de 45%. No parcelamento, os descontos serão menores, dependendo do número de parcelas que será usado para quitar a dívida (quanto maior o número de parcelas –máximo de 180– menor o desconto).

Outro ponto da lei que pode interessar principalmente para as empresas com parcelamento em andamento e que ainda possuem considerável saldo de prejuízo fiscal e base negativa de CSLL acumulados até 2013 e declarados até 30 de junho deste ano. Isso porque a lei trouxe um novo benefício. As empresas que têm quaisquer parcelamentos de débitos de natureza tributária (não necessariamente do próprio Refis) em andamento poderão antecipar a quitação até 70% do saldo devedor usando prejuízos fiscais e base negativa da CSLL. Para isso, terão de pagar os outros 30%, no mínimo, em dinheiro.
